40 CFR Part 63 Subpart ZZZZ
National Emissions Standards for Hazardous Air Pollutants for Stationary Reciprocating Internal Combustion Engines
Subpart ZZZZ sets national emission standards for hazardous air pollutants (HAP) from stationary reciprocating internal combustion engines (RICE), covering both spark ignition and compression ignition engines. Its tables cover stationary RICE located at major sources and area sources of HAP emissions. The subpart establishes emission and operating limitations, testing and compliance requirements, and notification, reporting, and recordkeeping obligations, with specific requirements varying by engine type, size, and source classification.
§ 63.6580
What is the purpose of subpart ZZZZ?
Subpart ZZZZ sets national emission limits and operating limits for hazardous air pollutants (HAP) from stationary reciprocating internal combustion engines (RICE) at both major and area sources of HAP. It also requires you to demonstrate initial and continuous compliance with those limits.
§ 63.6585
Am I subject to this subpart?
You are subject to this subpart if you own or operate a stationary reciprocating internal combustion engine (RICE) at a major or area source of hazardous air pollutants (HAP), except engines being tested at a test cell or stand. A stationary RICE is an engine that uses reciprocating motion to convert heat to mechanical work and is not mobile – it is not a non-road engine under 40 CFR 1068.30 and does not propel a motor vehicle or competition vehicle. A major source emits or can emit 10 tons per year or more of any single HAP or 25 tons per year or more of combined HAP (for oil and gas production, major-source status is determined separately for each surface site); an area source is any source that is not a major source. If you own or operate an area source subject to this subpart, being subject to this subpart does not by itself obligate you to obtain a permit under 40 CFR Part 70 or 71, provided you are not required to obtain one under 40 CFR 70.3(a) or 71.3(a) for another reason, but you must still comply with this subpart. Existing residential, commercial, or institutional emergency stationary RICE at area sources are not subject to this subpart if they meet the definition of emergency stationary RICE in § 63.6675 and do not operate for the purpose specified in § 63.6640(f)(4)(ii).
§ 63.6585(a)
A stationary reciprocating internal combustion engine (RICE) is any engine that uses reciprocating motion to convert heat into mechanical work and is not mobile. It is not a non-road engine as defined at 40 CFR 1068.30 and is not used to propel a motor vehicle or a vehicle used solely for competition.
§ 63.6585(b)
A major source of HAP emissions is a plant site that emits or has the potential to emit 10 tons or more per year of any single HAP, or 25 tons or more per year of any combination of HAP. For oil and gas production facilities, major-source status is determined separately for each surface site rather than across the entire plant site.
