49 CFR Part 195
Transportation of Hazardous Liquids by Pipeline
Part 195 covers the transportation of hazardous liquids by pipeline. It is divided into subparts on general provisions, annual, accident, and safety-related condition reporting, design requirements, construction, pressure testing, operation and maintenance, qualification of pipeline personnel, and corrosion control. The part also includes appendices on federal-state jurisdiction, a risk-based alternative to pressure testing older hazardous liquid and carbon dioxide pipelines, and guidance for implementing an integrity management program. The detail is in the listed subparts and appendices.
§ 195.1(a)
Covered
Part 195 applies to pipeline facilities that transport hazardous liquids or carbon dioxide in or affecting interstate or foreign commerce, including pipelines on the Outer Continental Shelf, except for the pipelines listed in paragraph (b). Covered pipelines include any pipeline that transports a highly volatile liquid, any pipeline segment that crosses a waterway currently used for commercial navigation, any pipeline located in a rural or non-rural area of any diameter regardless of operating pressure (except for gathering lines not covered by paragraph (a)(4)), onshore petroleum gathering lines in non-rural areas or that are regulated rural gathering lines under § 195.11 or located in an inlet of the Gulf of America under § 195.413, and for subpart B reporting purposes any gathering line not already covered by the other categories.
§ 195.1(a)(3)
This Part covers any pipeline (of any diameter or pressure) in rural or non-rural areas, except for gathering lines that are not covered by paragraph (a)(4). In other words, pipelines are covered unless they are gathering lines not covered by (a)(4) or are listed in the exclusions in paragraph (b).
§ 195.1(a)(5)
For purposes of the reporting requirements in subpart B only, this part also covers any gathering line that is not already covered by the four preceding categories of pipelines.
§ 195.1(b)(2)
This Part does not apply to hazardous liquid transported by gravity through a pipeline, except that the reporting requirements in subpart B (see § 195.13) still apply to gravity pipelines.
