49 CFR Part 192

Transportation of Natural and Other Gas by Pipeline: Minimum Federal Safety Standards

Part 192 establishes minimum federal safety standards for the transportation of natural and other gas by pipeline. It applies to pipeline operators and covers materials, design, construction, welding and joining, corrosion control, testing, operations, maintenance, personnel qualification, and integrity management for both gas transmission and distribution pipelines.

§ 192.1(a)

This part sets minimum safety requirements for pipeline facilities and gas transportation, including pipelines on the outer continental shelf as defined in 43 U.S.C. 1331.

§ 192.1(b)(1)

Part 192 does not apply to offshore gathering lines in state waters that are upstream of the outlet flange of the production facility or the first facility where produced hydrocarbons are separated, dehydrated, or otherwise processed, whichever is farther downstream.

§ 192.1(b)(2)

Part 192 does not apply to producer-operated pipelines on the Outer Continental Shelf that cross into state waters without first connecting to a transporting operator's facility on the OCS, upstream (generally seaward) of the last valve on the last production facility on the OCS. Safety equipment protecting PHMSA-regulated pipeline segments is not excluded from Part 192. Producing operators for those upstream pipeline segments may petition the Administrator (or designee) for approval to operate under PHMSA regulations governing pipeline design, construction, operation, and maintenance under 49 CFR 190.9.

§ 192.1(b)(5)(ii)

This exclusion applies to a pipeline system that delivers only petroleum gas or petroleum gas/air mixtures to one customer and is entirely on that customer's property – even if part of the system runs through a public area – and such systems are not covered by Part 192.
