40 CFR Part 60 Subpart OOOOc

Emissions Guidelines for Greenhouse Gas Emissions From Existing Crude Oil and Natural Gas Facilities

Subpart OOOOc sets out emissions guidelines for greenhouse gas emissions from existing crude oil and natural gas facilities. It includes provisions on the applicability of state or tribal plans, the use of a model rule, and standards for designated facilities including wells, compressors, controllers, pumps, storage vessels, fugitive emissions components, and process unit equipment. The model rule covers emission and work practice standards, testing, compliance requirements, recordkeeping, and reporting.

§ 60.5360c

What is the purpose of this subpart?

This subpart sets emission guidelines and compliance schedules for controlling greenhouse gas emissions from designated facilities in the crude oil and natural gas source category as defined in the Model Rule at § 60.5430c, in accordance with section 111(d) of the Clean Air Act and subpart Ba. The designated facilities, the standards section reference, and the compliance dates are listed in table 1 of this subpart. If this subpart's requirements conflict with the requirements in subpart A or Ba, this subpart's requirements control.

§ 60.5361c(a)

Scope

This subpart regulates greenhouse gases (GHG). The standards are in the form of a limitation on methane emissions from designated facilities in the crude oil and natural gas source category that commenced construction, modification, or reconstruction on or before December 6, 2022.

§ 60.5361c(b)(1)

This provision clarifies that, for purposes of 40 CFR 51.166(b)(49)(ii), with respect to greenhouse gas emissions from facilities, the "pollutant that is subject to any standard promulgated under section 111 of the Act" is considered to be the pollutant that is otherwise subject to regulation under the Act as defined in 40 CFR 51.166(b)(48). The same applies under any EPA-approved state implementation plan that is interpreted to incorporate, or specifically incorporates, 40 CFR 51.166(b)(48).

§ 60.5361c(b)(2)

This provision addresses how greenhouse gas emissions from facilities regulated in the plan are treated for purposes of 40 CFR 52.21(b)(50)(ii), which falls under the Prevention of Significant Deterioration (PSD) regulations. It says that, for those GHG emissions, the "pollutant that is subject to any standard promulgated under section 111 of the Act" is considered to be the pollutant that otherwise is subject to regulation under the Act, as defined in 40 CFR 52.21(b)(49).
