40 CFR Part 60 Subpart OOOOb

Standards of Performance for Crude Oil and Natural Gas Facilities for Which Construction, Modification or Reconstruction Commenced After December 6, 2022

Subpart OOOOb sets federal performance standards for crude oil and natural gas facilities for which construction, modification, or reconstruction commenced after December 6, 2022. It covers a wide range of equipment and operations including well completions, liquids unloading, associated gas wells, centrifugal and reciprocating compressors, process controllers, pumps, storage vessels, fugitive emissions components, process unit equipment, sweetening units, and super-emitter events. The subpart specifies who is subject, when compliance is required, emission standards (both GHG and VOC), testing and monitoring methods, initial and continuous compliance requirements, alternative compliance options, and detailed notification, reporting, and recordkeeping obligations, along with definitions and applicability of the general provisions in 40 CFR Part 60.

§ 60.5360b(a)

Scope

This federal subpart sets emission limits for methane (a greenhouse gas), volatile organic compounds (VOC), and sulfur dioxide (SO₂) from oil and gas facilities that start construction, modification, or reconstruction after December 6, 2022. It applies to affected facilities in the crude oil and natural gas source category and includes compliance schedules for meeting those limits.

§ 60.5360b(b)(1)

This provision clarifies that for purposes of 40 CFR 51.166(b)(49)(ii), with respect to greenhouse gas (GHG) emissions from facilities covered by this subpart, the pollutant that is subject to the standard promulgated under section 111 of the Clean Air Act is considered to be the pollutant that otherwise is subject to regulation under the Act as defined in 40 CFR 51.166(b)(48). This also applies under any EPA-approved state implementation plan (SIP) that is interpreted to incorporate, or specifically incorporates, 40 CFR 51.166(b)(48).

§ 60.5360b(b)(2)

This provision clarifies that for purposes of 40 CFR 52.21(b)(50)(ii), with respect to greenhouse gas (GHG) emissions from facilities covered by this subpart, the pollutant that is subject to the standard promulgated under section 111 of the Act is considered the pollutant that otherwise is subject to regulation under the Clean Air Act, as defined in 40 CFR 52.21(b)(49).

§ 60.5360b(b)(3)

This provision clarifies that for Title V operating permit purposes (under 40 CFR 70.2), with respect to greenhouse gas (GHG) emissions from affected facilities under this subpart, the pollutant that is subject to a standard under Clean Air Act section 111 is considered the pollutant that is otherwise "subject to regulation" as defined in 40 CFR 70.2.
