GP03 is a general construction permit for land development projects, issued January 24, 2020. The permit covers applicability, operating terms and conditions, recordkeeping, and general permit administration for land development activities.
I.A.
The owner or operator of any land development activity may register for this permit if it can comply with all the operating conditions in Section II and meets all the requirements of Section I.
I.B.
This permit covers land clearing, excavating, and grading for residential, commercial, industrial, or oil & gas exploration and production projects, but does not cover mining operations or disturbance of contaminated soils.
I.C.
Land development activities smaller than 25 contiguous acres and lasting less than 6 months do not need a permit and do not need to report air emissions to the Division. Operators of these projects must use appropriate control measures to minimize fugitive dust from the site.

These measures include: visible emissions from all activities must not exceed 20% and must not be transported off-property; on-site haul roads must not transport visible emissions off-property while off-site haul roads follow nuisance guidelines; and haul trucks must not transport visible emissions off-property when on the owner's property, and must not allow off-vehicle transport of visible emissions from the material when operating off the owner's property.
