STANDARDS OF PERFORMANCE FOR NEW STATIONARY SOURCES 5 CCR 1001-8

Colorado Regulation Number 6 sets standards of performance for new stationary sources. Part A adopts federal New Source Performance Standards (NSPS) by reference, and Part B establishes Colorado-specific (non-federal) standards for particular facilities and sources.

Introduction

Colorado adopts by reference certain federal EPA regulations from 40 CFR Part 60 and Part 75 as of specific dates listed elsewhere in the regulation, without later amendments. In the adopted Part 60 text, "Administrator" means the Colorado Air Pollution Control Division, except that for the sections listed in Table 1 it means both EPA and the Division. In the adopted Part 75 text, "Administrator" means EPA except for mercury monitoring, recordkeeping, and reporting, which are covered separately in Part B Section VIII of this regulation. All new, modified, or reconstructed air pollution sources must comply with these adopted standards, subject to any Colorado-specific deviations noted in the affected subpart or in Part B.

Table 1

Table 1 lists specific CFR sections within particular 40 CFR Part 60 subparts — A, Da, Ka, Kb, Kc, S, DD, GG, VV, WW, XX, XXa, GGG, JJJ, and KKK — plus, per the table's own footnote, any other section that 40 CFR Part 60 itself specifically states will not be delegated to the states.

Subpart Cb

Emission Guidelines and Compliance Times for Existing Sources: Municipal Waste Combustors That Are Constructed On or Before September 20, 1994

Colorado adopts by reference the federal emission guidelines in 40 CFR Part 60, Subpart Cb, as of July 1, 2025. Subpart Cb contains emission guidelines and compliance schedules for existing municipal waste combustors that were constructed on or before September 20, 1994. This is an adoption-by-reference record; the specific requirements are found in the federal subpart itself.

Subpart Cc

Emission Guidelines and Compliance Times for Municipal Solid Waste Landfills

Colorado adopts by reference the federal emission guidelines for existing municipal solid waste landfills at 40 CFR Part 60, Subpart Cc (July 1, 2025 edition). Landfills meeting the applicability condition in 60.33c(a)(1) must submit an initial design capacity report and an initial emission rate report to the Division within 90 days of the effective date. Facilities whose design capacity report meets the condition in 60.33c(a)(2) and whose initial NMOC emission rate report meets the condition in 60.33c(a)(3) (an NMOC emission rate that equals or exceeds 50 megagrams per year) must install air emission collection and control equipment by the later of 30 months from the effective date or the date the facility becomes subject to the subpart, and must submit a final collection and control system design plan for state approval within one year. On May 21, 2020, the Commission adopted an updated state plan for existing MSW landfills; once EPA approves it, landfills that began construction, reconstruction, or modification on or before July 17, 2014 will be subject to the updated plan, and sources previously under Subpart Cc will instead be subject to Subpart Cf.
