CONTROL OF EMISSIONS FROM VOLATILE ORGANIC COMPOUNDS AND PETROLEUM LIQUIDS STORAGE AND PETROLEUM PROCESSING AND REFINING 5 CCR 1001-28

Colorado Regulation Number 24 controls emissions of volatile organic compounds (VOC) from petroleum liquids storage, transfer, disposal, processing, and refining operations. The regulation includes applicability and general provisions (Part A), specific requirements for storage, transfer, and disposal operations and petroleum processing and refining (Part B), and engineering criteria for vapor control during gasoline transfer to storage tanks and at bulk plants (Appendices B and C).

I.A.1.a.

This regulation applies in four geographic areas: the Denver 1-hour ozone attainment/maintenance area, any nonattainment area for the 1-hour ozone standard, the 8-hour Ozone Control Area, and northern Weld County.

I.A.1.b.

(State Only) All provisions of this regulation apply to any ozone nonattainment area in Colorado, meaning areas designated nonattainment for either the 1-hour or 8-hour ozone standard, unless Section I.A.1.c. says otherwise. The maps and attainment-status chronologies for Colorado's ozone nonattainment or attainment maintenance areas are in Appendix A of this regulation.

I.A.1.c.

Part B Sections III, IV.B.1., IV.B.2., and V.C. apply statewide in Colorado. Provisions marked "(State Only)" are not federally enforceable unless the text says otherwise.

I.B.1.a.

New sources in the 1-hour ozone nonattainment area or attainment maintenance area must comply with this regulation when they start operating if they submitted a complete permit application on or after October 30, 1989, or (if no permit is required) commenced operation on or after October 30, 1989. This applies only to sources located in the 1-hour ozone nonattainment or attainment maintenance area, not statewide.
