Code of Colorado Regulations · Regulation Number 11

MOTOR VEHICLE EMISSIONS INSPECTION PROGRAM 5 CCR 1001-13

Colorado Regulation Number 11 establishes the state's motor vehicle emissions inspection program, covering inspection procedures, emissions limits, equipment standards, and licensing requirements for inspection stations, mechanics, and inspectors. The regulation applies to vehicle owners subject to emissions testing, licensed inspection and repair facilities, emissions inspectors and mechanics, fleets, and motor vehicle dealers operating test facilities. It sets maximum allowable emissions limits for light-duty and heavy-duty vehicles, prescribes test procedures for exhaust, evaporative and visible emissions and on-board diagnostics, defines program areas (basic and enhanced) and exemptions, and establishes prohibited acts and penalties to ensure proper inspections and repairs.

I.

All non-diesel motor vehicles registered in the AIR Program area (defined by C.R.S. 42-4-304(20) as amended by Senate Bill 09-003) are subject to an On-Board Diagnostics and/or exhaust, evaporative emissions, and smoke opacity inspection as a prerequisite to initial or renewal registration, following the schedules in Sections I.C. and V.B. Non-residents who meet the requirements of C.R.S. 42-4-310(1)(c)(I) are also subject to inspection. Employers and post-secondary schools in the program area must annually notify employees and students in writing of the requirement to comply. The portions of this regulation applicable to Larimer and Weld counties are not included in the state implementation plan.

I.A.

This regulation applies to the AIR Program area, which is defined in C.R.S. § 42-4-304(20) as amended by Senate Bill 09-003. (The specific counties or boundaries of the AIR Program area are not spelled out here.)

I.B.

This regulation applies to all motor vehicles as defined in C.R.S. § 42-4-304(18). If your vehicle is registered in a program area but you are driving it outside that area in another program area, you must comply with the requirements of the area where you are operating the vehicle. If your vehicle is registered in a program area but is temporarily out of state when registration or renewal is due, you may apply to the Department of Revenue for a temporary exemption; when you return to the program area you have fifteen days to come into compliance. The Department of Revenue will not grant a temporary exemption if the vehicle will be operated in another state's emissions testing area unless you submit proof of emissions from that area. If you operate a vehicle in the enhanced program area you must comply with the enhanced program. The vehicle owner has the burden of proving any exemption from AIR Program inspection requirements.

I.C.2.

Starting in calendar year 1995 and continuing thereafter, vehicles must be inspected according to the schedules set out in Colorado statutes sections 42-4-304(3)(b)(II) and 42-4-310(1)(b)(II), C.R.S. as amended.
